These Terms of Service govern access to and use of Digiso Media websites, subscription services, creative work, communications, files, previews and related offerings provided by Digiso Media, LLC. By using the website, purchasing a subscription or submitting a request, the client agrees to these Terms on behalf of themselves or the organization they represent.
Services
Digiso provides custom digital creative services, including branding, website design, basic website development, marketing assets, presentation assets, creative direction, previews and related production support. Service details, delivery timelines and included work may vary by plan, request type, available materials and scope.
Subscriptions and billing
- Subscriptions are billed in advance through the selected payment provider.
- Clients are responsible for maintaining accurate billing information and paying all charges associated with the selected plan.
- Plans may be paused, resumed or cancelled according to the options Digiso makes available at the time.
- Digiso may suspend or stop service for unpaid invoices, payment disputes, abuse, chargeback threats or violations of these Terms.
Requests, scope and delivery
- Clients may submit requests for work that fits the subscription scope and provide priorities, context, files, brand assets and feedback.
- Delivery estimates are not guarantees. Larger requests may be split into smaller milestones or declined if they fall outside the subscription scope.
- Digiso may refuse requests involving native mobile engineering, complex backend platforms without clear milestones, media buying, compliance review, unlawful material or unclear approval workflows.
- Client delays, missing assets, unclear feedback or approval delays may affect delivery timing.
Returns and refunds
Digiso provides custom digital creative services. Payments are generally non-refundable once work has started, requests have been submitted, feedback has been given, deliverables have been provided or the subscription has otherwise been used during a billing period.
- Refund requests are reviewed case by case and are granted only at Digiso Media, LLC's discretion.
- Approved refunds, if any, are limited to unused subscription time in the current billing period as determined by Digiso.
- Payment processing fees, including Stripe fees, are non-refundable.
- If a refund is approved, rights to work produced during the refunded service period may revert to Digiso, and the client must stop using those materials unless Digiso agrees otherwise in writing.
- Digiso may refuse refunds in cases of abuse, excessive refund requests, chargeback threats, substantial service use or violation of these Terms.
Ownership of work
After payment is received and work is approved or delivered, the client owns the final approved designs, exported assets and delivered code created specifically for that client, except for third-party materials, pre-existing Digiso materials, tools, templates, frameworks, libraries and materials otherwise identified as separately licensed.
Client materials and third-party licenses
- The client represents that any materials provided to Digiso, including logos, copy, images, fonts, data, brand assets and reference materials, are owned by the client or properly licensed for use.
- The client is responsible for obtaining licenses for third-party fonts, photos, software, plugins, stock assets or other materials required for legal use unless Digiso states otherwise in writing.
- Licenses held by Digiso are not automatically transferable to the client.
Feedback, portfolio use and confidentiality
- Digiso may use client feedback, suggestions or comments to improve its services without owing compensation.
- Digiso may showcase completed work, project visuals and general results on its website, portfolio, social channels or sales materials unless a separate written confidentiality agreement or NDA prohibits it.
- Clients should not submit confidential, regulated or sensitive information unless Digiso has agreed in writing to handle that information under specific confidentiality terms.
Website and platform use
- Clients may not misuse the website, attempt unauthorized access, interfere with security features, scrape data, reverse engineer software, upload malicious code or use the service for unlawful purposes.
- Digiso may monitor use of its website, previews, forms and service channels to protect the company, clients and service quality.
- Digiso may restrict access, remove materials or terminate service when necessary to protect its rights, systems, team or clients.
Availability and third-party services
Digiso uses third-party services for payments, hosting, communications, storage, analytics and related operations. The website, previews, checkout links and service tools may be unavailable from time to time due to maintenance, provider issues or events outside Digiso's control.
Disclaimers and limitation of liability
The website and services are provided on an as-is and as-available basis. Digiso does not guarantee specific business outcomes, revenue, traffic, rankings, conversions or uninterrupted access. To the fullest extent allowed by law, Digiso Media, LLC will not be liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost data or business interruption.
Changes to these Terms
Digiso may update these Terms from time to time. Continued use of the website or services after an update means the client accepts the updated Terms.
